Forty Days, or Eighty

Eight verses on purification after childbirth, and they contain an asymmetry the text never explains. After a son: seven days unclean, then thirty-three of purification. After a daughter: fourteen, then sixty-six — exactly double. Every account of why is supplied from outside the chapter, and the confident ones in both directions go past the evidence. Two things the text does say are worth holding: the closing offering is identical for a son and a daughter, and this is impurity rather than sin — bearing children is commanded in Genesis, and nothing here suggests wrongdoing. The chapter ends with the concession Luke would quote a thousand years later: if she cannot afford a lamb, two birds.

2Speak unto the children of Israel, saying, If a woman have conceived seed, and born a man child: then she shall be unclean seven days; according to the days of the separation for her infirmity shall she be unclean.

3And in the eighth day the flesh of his foreskin shall be circumcised.

4And she shall then continue in the blood of her purifying three and thirty days; she shall touch no hallowed thing, nor come into the sanctuary, until the days of her purifying be fulfilled.

5But if she bear a maid child, then she shall be unclean two weeks, as in her separation: and she shall continue in the blood of her purifying threescore and six days.

6And when the days of her purifying are fulfilled, for a son, or for a daughter, she shall bring a lamb of the first year for a burnt offering, and a young pigeon, or a turtledove, for a sin offering, unto the door of the tabernacle of the congregation, unto the priest:

7Who shall offer it before the Lord, and make an atonement for her; and she shall be cleansed from the issue of her blood. This is the law for her that hath born a male or a female.

8And if she be not able to bring a lamb, then she shall bring two turtles, or two young pigeons; the one for the burnt offering, and the other for a sin offering: and the priest shall make an atonement for her, and she shall be clean.^↗

Dead Sea Scrolls

The well-published Qumran Leviticus manuscripts do not cover this chapter. 4Q120 ends at 5:25; 11Q1’s preserved fragments run 10:4-7 and then 11:27-32 and 13:3-9; 4Q23 begins at 13:32.

A caution about coverage. Leviticus survives at Qumran in more than a dozen Hebrew manuscripts, several in paleo-Hebrew, plus copies from Masada, and many are small and fragmentary. Statements that no manuscript preserves a given chapter are easy to make and easy to get wrong, so TELL names what the well-published scrolls cover and does not assert absence beyond that.

Purity legislation is the sect’s most abundant subject. Beyond the biblical scrolls, Cave 4 produced a set of texts modern editors label 4QTohorot — purity rulings covering bodily impurities and their durations — and the Temple Scroll (11Q19) sets out where various categories of impure people must be kept relative to the city and the sanctuary. A community organizing its whole life around graded purity read chapters like this one as operative law rather than as history.

In the Quran

The Quran has no postpartum purity legislation, and the absence is consistent: it has no sanctuary that impurity could defile, and no priest to declare anyone clean.

What it addresses instead is the mother. Luqman 31:14 and al-Ahqaf 46:15 both dwell on what bearing and nursing a child costs — his mother carried him in weakness upon weakness, and his bearing and weaning is thirty months — and both attach a command to be grateful to parents. The subject of the passage is obligation owed to her, not her status.

Menstrual restriction does appear, and it is narrow. al-Baqara 2:222 answers a question about menstruation by calling it a harm and instructing abstention from intercourse until purity returns. Post-childbirth bleeding (nifas) is treated the same way in later Islamic law, with a maximum period conventionally set at forty days — a figure that matches the son’s total in Leviticus 12:4, though the two traditions arrive at it independently and mean different things by it.

And there is no differential for the sex of the child anywhere in the Quran. On the contrary, al-Nahl 16:58-59 and al-Takwir 81:8-9 attack the practice of grieving at the birth of a daughter and of burying infant girls alive — which makes the silence of Leviticus 12 about its own asymmetry more conspicuous, not less.

No place is named. The pin marks Jebel Musa, the traditional Sinai. The one movement in the chapter is at the end: the woman brings her offering to the door of the tent of meeting. Verse 8’s concession — two birds if she cannot afford a lamb — is the verse Luke 2:24 quotes when Mary and Joseph come to the Temple in Jerusalem, which is the same rule applied a thousand years later in a stone building.
